ACCOMMODATION
AGREEMENT

Article 1: Scope of Application

1. Contracts for accommodation and related agreements concluded between HOTEL BIACLYN HAKODATE (hereinafter referred to as “the Hotel”) and a guest shall be governed by the provisions of these Terms and Conditions. Matters not stipulated herein shall be governed by applicable laws, regulations, hotel usage rules, and/or generally established customs.

2. In cases where the Hotel has entered into a special agreement with the guest to the extent not violating the applicable laws, regulations, or customs, such special agreement shall prevail over these Terms and Conditions.

Article 2: Application for Accommodation Contract

1. A person applying for an accommodation contract with the Hotel shall provide the following information:

(1) Name of the guest

(2) Date of accommodation and estimated time of arrival

(3) Basic accommodation charges (based in principle on the rates listed in Appendix 1)

(4) Other information deemed necessary by the Hotel

2. If the guest requests to extend their stay beyond the dates indicated in item (2) above during the course of their stay, such request shall be regarded as a new application for an accommodation contract at the time the request is made.

Article 3: Conclusion of Accommodation Contract

1. The accommodation contract shall be deemed concluded when the Hotel accepts the application as specified in the preceding Article. However, the same shall not apply if the Hotel proves it did not accept the application.

2. Upon the conclusion of the accommodation contract under the preceding paragraph, the guest shall pay an application deposit equivalent to the basic accommodation charges for the full period of stay by the date designated by the Hotel.

3. The application deposit shall first be applied to the total accommodation charges payable by the guest, then to cancellation charges under Article 6 and Article 18, and any remaining balance shall be refunded at the time of payment under Article 12.

4. If the guest fails to pay the application deposit by the date designated by the Hotel, the accommodation contract shall become null and void. However, this shall apply only if the Hotel has notified the guest of such effect when designating the payment deadline.

Article 4: Special Agreements Not Requiring Deposit Payment

1. Notwithstanding the provisions of Article 3 Paragraph 2, the Hotel may enter into a special agreement waiving the payment of the application deposit.

2. If the Hotel does not request payment of the deposit or does not specify the deadline for such payment at the time of accepting the application, it shall be deemed that the Hotel has agreed to the special agreement in the preceding paragraph.

Article 5: Refusal to Conclude Accommodation Contract

The Hotel may refuse to conclude an accommodation contract in any of the following cases:

(1) When the application does not comply with these Terms and Conditions

(2) When there are no available rooms due to full occupancy

(3) When the guest is deemed likely to violate laws, public order, or good morals during their stay

(4) When the guest falls under any of the following:

(i) An organized crime group, a member of such a group, an associate member, or any anti-social force

(ii) A corporation or entity controlled by such a group

(iii) A corporation with a board member who is a member of such a group;

(5) When the guest has caused significant disturbance to other guests

(6) When the guest is a patient of a designated infectious disease as defined by law

(7) When the guest makes violent or unreasonable demands beyond socially acceptable limits

(8) When the guest repeatedly makes requests that would cause undue burden on the Hotel and seriously hinder services to other guests

(9) When accommodation cannot be provided due to natural disaster, facility failure, or other unavoidable reasons.

Article 6: Guest’s Right to Cancel the Contract

(1) The guest may cancel the accommodation contract by notifying the Hotel.

(2) If the contract is canceled due to reasons attributable to the guest (excluding cancellation prior to payment of the deposit under Article 3 Paragraph 2), cancellation charges will apply as set forth in Appendix 2.

(3) If the guest does not arrive by 6:00 p.m. on the accommodation day (or two hours past the scheduled arrival time), the Hotel may regard the contract as canceled unless the guest has contacted the Hotel.

Article 7: Hotel’s Right to Cancel the Contract

1. The Hotel may cancel the accommodation contract in any of the following cases:

(1) When the guest is likely to or has violated laws, public order, or good morals during their stay

(2) When the guest is found to be a member or affiliate of an organized crime group or other anti-social force

(3) When the guest causes significant disturbance to other guests

(4) When the guest is a patient of a designated infectious disease

(5) When the guest makes violent or unreasonable demands beyond acceptable limits

(6) When the guest makes repeated requests that would unduly burden the Hotel and hinder services to others

(7) When accommodation becomes impossible due to natural disasters or other force majeure

(8) When the guest violates hotel usage rules, such as smoking in prohibited areas or tampering with fire safety equipment.

2. If the Hotel cancels the contract under the preceding paragraph, the guest shall not be charged for services not yet received.

Article 8: Registration for Accommodation

1. Guests shall register the following information at the front desk on the day of their stay:

(1) Name, address, and contact details

(2) Nationality and passport number (for non-resident foreigners)

(3) Other information deemed necessary by the Hotel.

2. Guests intending to pay by credit card or other alternative methods must present such methods at the time of registration.

Article 9: Use of Guest Rooms

1. Guest rooms may be used from 3:00 p.m. on the day of arrival until 11:00 a.m. the next day. For consecutive stays, rooms may be used throughout the day, excluding check-in and check-out days.

2. Additional charges apply for use beyond the above hours:

(1) Up to 3 hours: 30% of room rate

(2) Up to 6 hours: 50% of room rate

(3) Over 6 hours: 100% of room rate

Article 10: Compliance with Hotel Rules

Guests must comply with the Hotel’s usage rules posted within the premises.

Article 11: Business Hours

1. Operating hours for main facilities are provided in the in-room information book. These include:

(1) Front Desk Services

(2) Dining Services: Breakfast, Dinner, and others

(3) Additional Facilities: Wellness Space, Gym, Gift Shop, Library

2. Operating hours are subject to change due to necessity or unforeseen circumstances. Any changes will be communicated appropriately.

Article 12: Payment of Charges

1. The breakdown and calculation of accommodation charges are provided in Appendix 1.

2. Payment is due at check-out or upon request at the front desk and may be made in cash, credit card, or other accepted methods.

3. If a guest chooses not to stay after room provision becomes possible, full accommodation charges shall still apply.

Article 13: Hotel’s Liability

1. The Hotel shall compensate for damages caused by its non-performance of contracts unless not attributable to the Hotel.

2. The Hotel holds fire insurance and liability insurance.

Article 14: Inability to Provide Contracted Room

1. If the Hotel cannot provide the contracted room, it will attempt to arrange alternative accommodation with the guest’s consent.

2. If no alternative is arranged, the Hotel shall pay compensation equivalent to the cancellation fee unless not attributable to the Hotel.

Article 15: Handling of Deposited Items

1. The Hotel shall compensate for damage or loss of items, cash, or valuables deposited at the front desk, unless due to force majeure. Compensation for undeclared valuables is limited to ¥150,000.

2. For undeclared items not deposited at the front desk, the Hotel is liable only for intentional or gross negligence, with a compensation limit of ¥150,000.

Article 16: Custody of Luggage and Belongings

1. Luggage received prior to arrival shall be stored only if the Hotel has agreed in advance.

2. Forgotten items will be stored for 7 days after discovery and then reported to the nearest police station if unclaimed.

3. Responsibility for stored items follows the same provisions as in Article 15.

Article 17: Parking Liability

1. The Hotel only provides space for parking and does not accept responsibility for vehicle management. Compensation is limited to damages caused by Hotel fault or negligence.

Article 18: Guest Responsibility

1. Guests shall compensate the Hotel for any damage caused by their intentional or negligent actions, as well as for the unauthorized removal of hotel property or furnishings.
